1. GENERAL PROVISIONS
1.1 These Terms and Conditions define the rules for using the online shop Bison Gear โ Overland Accessories, available at https://bison-gear.com, operated by Bison Gear Sp. z o.o., and in particular the terms of placing orders, creating user Accounts, making payments, deliveries, withdrawal from contracts, complaint procedures, and the principles of using the Account as a digital service.
1.2 Customers are required to read and accept these Terms and Conditions before using the Shop.
2. DEFINITIONS

Account โ a digital service provided free of charge by the Service Provider to the Customer, enabling access to additional features of the Shop.

Consumer โ a Customer who is a natural person entering into a contract not directly related to their business or professional activity.

Consumer Rights Act โ Polish Act of 30 May 2014 on consumer rights.

Customer โ any person or entity that uses or intends to use the services of the Shop.

4. TECHNICAL REQUIREMENTS
To properly use the Shop and create an Account, the following are required:

An internet-connected device,

A modern web browser with JavaScript and cookies enabled,

An active email account.
5. PRODUCTS AND ORDERS
5.1 The Shop offers physical goods including overland and off-road accessories.
5.2 Full product descriptions, prices, and photos are available on each product page.
5.3 Orders are placed via the website by adding products to the cart and completing the checkout process.
5.4 The sales contract is concluded once the Service Provider confirms the order by email.
5.5 The Customer is responsible for providing accurate and truthful order information.
6. ACCOUNT
6.1 Creating an Account is voluntary.
6.2 The Account allows the Customer to access order history, check order status, and manage personal data.
6.3 To create an Account, the Customer completes the registration form on the website.
6.4 Upon Account creation, an indefinite contract is formed between the Customer and the Service Provider.
6.5 The Service Provider starts delivering the Account service immediately after the contract is concluded.
6.6 The Customer may delete their Account at any time, free of charge, by sending an email request.
6.7 Account deletion terminates the contract for the provision of the Account.
7. PAYMENTS
7.1: All prices displayed in the Shop are shown in the local currency, determined based on the customer's location. For orders within the European Union, prices include taxes (VAT). For orders within the United Kingdom, prices include taxes (VAT) and applicable duties. For orders within the United States, prices include duties. For other countries, local taxes and duties may apply.
7.2 Payment methods include those indicated during the ordering process (e.g., credit card, online transfer, etc.).
7.3 Promotions and discount codes do not combine unless expressly stated otherwise.
7.4. The 5% discount offered for subscribing to the newsletter is valid for 72 hours from the time of subscription and cannot be combined with other promotions or discount codes.
7.5 If payment is not received within the specified period, the Service Provider may cancel the order.
8. DELIVERY
8.1 Orders are shipped to the address provided by the Customer during checkout.
8.2 Shipping methods, costs, and estimated delivery times are presented during the order process.
8.3 The cost of shipping is based on the weight and destination of the ordered products.
8.4 Free shipping thresholds are as follows:
- For the United States: free shipping applies to orders above 350 USD,
- For European Union countries: free shipping applies to orders above 300 EUR,
- For United Kingdom: free shipping applies to orders above 300 GBP,
- For Poland: free shipping applies to orders above 100 PLN.
8.5 In all other countries, shipping costs are calculated and displayed at checkout after the Customer enters the shipping address.
8.6 The risk of damage or loss passes to the Consumer upon delivery; for non-consumers, upon handover to the carrier.
9. RIGHT TO WITHDRAW FROM THE CONTRACT
9.1 Consumers have the right to withdraw from a distance contract within 14 days without giving any reason.
9.2 The withdrawal period starts:

from the delivery date for physical products,
-
from the contract date for the Account (digital service).
9.3 To withdraw, the Consumer must notify the Service Provider (see Article 3) using an unambiguous statement (e.g., email or post). The withdrawal form in Appendix 1 may be used but is not mandatory.
9.4 Sending the withdrawal statement before the 14-day deadline is sufficient.
9.5 In case of withdrawal, the Service Provider shall refund all payments received within 14 days using the same payment method unless agreed otherwise.
9.6 Returns are not accepted if the Customer fails to notify the Service Provider of their intention to withdraw from the contract within the 14-day period from the date of delivery.
9.7 Returns will not be considered if the Customer does not notify the Service Provider of their intention to return the product within 14 days of receiving the shipment.
9.8 The cost of returning a non-defective (fully functional) product is the responsibility of the Customer.
9.9 The Customer is obligated to package the returned product as securely as possible to prevent any damage during return shipping.
10. COMPLAINTS
I. PRODUCTS
10.1 The Service Provider is liable for product defects in accordance with applicable consumer protection laws.
10.2 Complaints about physical products can be submitted via email or post. The Customer should provide a description of the issue and proof of purchase.
10.3 Complaints will be processed within 14 days.
II. ACCOUNT / DIGITAL SERVICES
10.4 The Service Provider is liable for the conformity of digital services (Account) with the contract as required by the Consumer Rights Act.
10.5 If the Account does not function properly, the Consumer may:

Request conformity,

Withdraw from the contract under certain conditions,
-
Expect prompt correction or improvement of service.
III. ALTERNATIVE DISPUTE RESOLUTION
10.6 Consumers may use alternative out-of-court dispute resolution methods such as:

European Consumer Centres (ECC-Net),
-
Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr,
-
Local ombudsman or mediation services in Poland.
10.7 Use of such methods is voluntary and does not exclude judicial proceedings.
11. PERSONAL DATA
11.1 The Service Provider is the controller of the Customerโs personal data.
11.2 Data is processed to fulfill the contract (Art. 6(1)(b) GDPR) and for legitimate interests such as handling claims (Art. 6(1)(f) GDPR).
11.3 Providing data is voluntary but necessary for the contract.
11.4 Data is stored until:

The contract ends,
-
Claims become time-barred,
-
Objection is accepted (if processing is based on legitimate interest).
11.5 Customers have the right to access, correct, delete, restrict processing, transfer their data, and object to processing.
11.6 Complaints regarding data protection can be filed with the President of the Personal Data Protection Office in Poland.
12. CHANGES TO THE TERMS AND CONDITIONS OR TO THE ACCOUNT
12.1 The Service Provider may amend the Terms and Conditions for valid reasons (e.g., legal changes, new features, contact details updates).
12.2 Customers will be notified by email at least 7 days before changes take effect.
12.3 Lack of objection equals acceptance of changes.
12.4 Objection before the effective date terminates the Account contract at that moment.
12.5 Functional updates that do not affect conformity are applied without additional cost to the Consumer.
12.6 If a change significantly limits access or usage, the Consumer will be informed in advance via a durable medium.
13. FINAL PROVISIONS
13.1 The Customer is prohibited from providing unlawful content.
13.2 The contract is concluded in English and governed by Polish law, unless mandatory laws in the Consumerโs country provide greater protection.
13.3 For disputes with non-Consumers, the court having jurisdiction over the Service Providerโs registered office applies.
13.4 Nothing in these Terms limits Consumer rights under applicable law.
13.5 Entrepreneurs acting outside their professional capacity may enjoy Consumer rights if the contract is not of a professional nature.
13.6 Liability toward non-Consumer Customers is limited to the extent permitted by law.
